Why When I Buy a Gun Does It Require Further Review

  1. I had a foreign experience today, was wondering if anyone else has had a similar experience.

I went to pick upward my layaway, a handgun. I was right adjacent to the guy when he called in my 4473. I wasn't really paying attention as I've had effectually ii dozen 4473s called in in the last three years that I've been buying guns. Then I heard him repeat "further review." Later about 30 seconds he repeated "proceed" and we completed the auction. Every bit far as I know, I've never had a delay of whatsoever kind, so this farther review matter threw me. I asked the salesman nigh information technology and he said that almost as before long as the phonation on the other cease of the line said "further review," another phonation came on and said "proceed."

As far as I know, I accept no criminal tape, aside from a couple speeding tickets. Two months ago I was cleared for a authorities photograph ID (not a security clearance, just an ID), for my federal task, which required a adequately in-depth FBI background check. I besides hold a CCP for my abode state of SD.
Why would I get this farther review thing, and why would they come back in seconds and say proceed? I ever include my SSN on the 4473, wouldn't that prevent mis-identification?

This was at my local store, at about 5:45 PM, MTN time, on a Midweek.

The only thing I can think of is that I recently inverse my accost and this was the start 4473 I'd filled out since, only again, isn't that what the SSN is for?

Since the auction was able to keep, I'm assuming I'm righteous, but the whole thing was disconcerting.

  2. Conjecture simply - but I'm retired from federal service - the reviewing office possibly noted a note with your name/SSAN saying "FBI inquiry".

And then he noted the coding which means 'routine inquiry for background check purposes' and realized information technology wasn't anything derogatory.

That would have been the 'farther review'.

Like I said, it'south conjecture. Simply I take an idea of how the system works.

  3. Could this have anything to practice with the number of guns purchased over the terminal 3 years?
Seems similar 24 in 36 months could set off an alarm.
  4. Archie is likely correct.

Your firearm buy history has nothing to do with information technology.

  5. Every ane of my 4473 transactions over the last few years has gone through the "further review" process. Takes an additional 30 seconds each time.

Most likely someone with a similar terminal name made it into one of the many databases used by the NICS. Your 4473 has to be bumped upward a level to someone who has access to more protected info (to verify that you lot're not that person) than the call center person.

    http://www.fbi.gov/nigh-us/cjis/nics/full general-information/fact-sheet

  6. Number and types of guns purchased has nothing to exercise information technology. Most likely something has inverse, due east.grand. there's someone with a very similar proper name/DOB/POB/etc. who was recently entered as a prohibited person, the figurer couldn't resolve it, so a person had to cheque your stats against the other record to make certain that you weren't prohibited.
  7. This happened to me last fourth dimension too. Information technology's probably as 45_auto says. I know specifically that I have an evil twin: same first and last name, same verbal birthday, same city of birth. The centre name and naturally SSN are unlike. My "evil twin" has very bad fiscal problems (I become his drove notices sometimes - though due to the SSN they never show up on my report so I don't much care), and during a traffic stop where the cop was confused for a flake I learned that he had been to jail on a narcotics charge.

Last time happened merely equally you lot said - "farther review", then presently thereafter "Proceeed". Just a hunch on how these things work, merely my estimate is that "farther review" is going every bit far every bit they can without using the SSN, so they need to exercise another lookup using that. If you become the "farther review" with the SSN listed my estimate is you lot'd get a filibuster or a deny if you failed to listing information technology.

  8. When a dealer calls in an FBI NICS check the initial call is taken by a customer service rep. The CSR volition ask final name, showtime name, heart name, cadence (jr, sr III), place of nascency, ht, wt, gender, birth engagement, Social Security #, race, country of residence, citzenship and then "type of firearm?".

The CSR volition and then give the dealer the NTN (NICS transaction number) followed by a response that the transaction may "Go on" or that the transaction requires "Farther Review" from a NICS Examiner (authorized to admission additional records). The CSR will ask the dealer to confirm the status they just said five seconds before....that'due south why y'all heard the dealer repeat "farther review"......then the CSR transfers the call to a NICS Examiner.

The NICS Examiner volition inquire for the NTN and usually says "do y'all mind holding?" typically they accept less than a infinitesimal to review the customers information and compare it to their database. Depending on what information is found, and so the NICS Examiner will give a Go along, Denied or Delayed response. If the response is a Delay, the NICS Examiner will say " the Brady Law does non prohibit the transfer of this firearm after xx/xx/2011". If the response is a Denied, they volition non tell the dealer or customer over the telephone why the transaction was denied....the dealer gives the client the NTN and a NICS Appeals brochure. the client would then contact the FBI for the reason for his Denied response.

I have several customers who ALWAYS become a Delay, even with their SSN written in. Sometimes the NICS Examiner will need to check state records that may not exist bachelor when the NICS call was made.

Top secret clearances, previous FBI checks, LEO, whatever......none have any bearing on an FBI NICS cheque. By constabulary, the FBI CANNOT salvage your information unless you lot request they practice so. Past law the data submitted today is deleted at the close of the NICS business solar day for all "Go along" transactions. Transactions that resulted in a "Delay" will stay active until that transaction results in a "Proceed" (and then deleted at the end of that NICS business organization day. All transactions that resulted in a "Denied" response take the information saved per Federal constabulary.

At present a South Dakota let is not an exemption to the FBI NICS cheque. this may be due to the level of the groundwork bank check that SD does for permits or to the length of time the allow is valid...."lifetime" permits for example (from whatsoever land) are not valid as an exemption to NICS.

FBI NICS doesn't ask for your street address. If y'all moved to another state, however wrote down your former state as the "state of residence" so you lot would only be permtted to purchase a rifle or shotgun.
  9. This happened to me when I bought my LCP in September here is the thread I started nigh it then.

my guess is that information technology happened to me because this is the first gun I bought since I moved to Washington.

  10. Completely different accept on this 'cause this happens to united states of america on a recurring footing in VoIP environments.

They probably had a glitch in their IVR (interactive voice response) script or their phone system - voice echo/bleed-over.

  11. Thank you for your replies, guys! Then the whole thing could have simply been a glitch or spelling error? My final proper name is not mutual or uncommon, but I've noticed that people tend to mishear it over the phone...
  12. I'm really not looking forwards to this. I'm going through the state of NJ procedure now. I take a very common name, and I already know from the NJ background bank check that in that location is a guy wanted in Colorado who has the aforementioned proper noun (fifty-fifty the middle name) and his Social Security number is close to mine. He is one inch shorter.
  13. Information technology happens to me every time I purchase a firearm on a weekday. Further review, and 30 seconds later Proceed. When I try and purchase a firearm on a weekend, I get Delay. If I don't fill in my SSN, I get delay. This seemed to beginning happening nearly two years ago when I got my TWIC card, then I assume information technology does take something to do with a note existence in the computer that homeland security ran a BG Check on me. Every bit I am not dwelling much and just for 3 day periods of fourth dimension, I either have gotten used to picking upwards my firearm iii weeks afterwards if I'thou not using my normal dealer. If I use my normal dealer, Its commonly considering I have had them order it in, and so I fill up out the 4473 at the time I place the order, and phone call them to remind them to process information technology a few 24-hour interval before I go home. They were telling me last time how the ATF guy game by, noticed and gave them a footling crap nearly doing it that way, only was ok with it after they explained the situation.
  14. Don't rule out the possibility that in your particular situation someone in preparation was just new and was looking at the wrong matter on the screen or playing it safe.

FWIW, I just picked upwards a used 1911. The simply things my dealer answered were full name, my acquit ID number, and type of firearm. Nothing else. Makes me realize putting my SS# on any 4473 in the hereafter is not needed.
  16. If it'south any condolement to anyone, I've got a 'biographical data well-nigh miss evil twin' on file. I've never met him, only his concluding name is the aforementioned as mine, get-go and heart same initials, DOB close enough.

He was wanted on a murder charge for awhile. Our physical descriptions and residence areas are quite different, happily.

  17. Thats considering he didn't call NICS. Y'all live in Utah....look at the NICS map above and you'll see that the red states call a state POC (point of contact), not the FBI NICS.
  18. Don't worry also much about the delay response. I have had numerous groundwork checks during my 22 years in the Air Forcefulness, ever acme secret clearances, then government contractor later that, and I agree a Texas CHL and Utah CHL.

I have a 2nd home in New Mexico and every fourth dimension I purchase a gun there I ALWAYS get a filibuster. Sometimes it's a few minutes, sometimes next mean solar day. I accept just learned to live with it, no reason to get a UPIN really.

Nice thing about living in Texas is that if you hold a valid CHL no NICS bank check has to be done. Just show your menu and walk out with the gun.

  19. They probably were suspicious because yous were non giving your guns abroad to a Drug Cartel. It helps to be involved with the Sinaloa boys. :D

dogtown, I run across at present. I judge I didn't understand the nautical chart at offset glimpse, and I assumed that even if going through a POC, they were still performing a NICS check.

Kinda makes yous wonder the validity of all the "data" they have if not all checks are going/coming from the same people.

  21. The worst office is dealers in POC states often are charged for every Brady bank check they perform.....continue or deny.

The FBI NICS bank check is a price free phone call and a costless service available seventeen hours a day, Monday through Fri, every day of the year except Christmas Twenty-four hours.. Its pathetic that some states chose to opt out and indistinguishable what the FBI does for free.

  22. Ummmmm..... can I enquire which is it, please? "Mon through Friday" or "every day of the twelvemonth except Christmas Day"? :uhoh:
  23. Apply for i of those PIN numbers that just you know to ID yourself as you when ownership guns.
  24. Information technology'due south both :D
